INTRODUCTION:
The
process of economic reforms in India in the 1990s resulted in the
emergence of independent regulators in certain key sectors of the
economy including the power sector. In 1998, the Electricity Regulatory
Commissions (ERC) Act was passed providing for the establishment
of central and state electricity regulatory commissions. The Electricity
Act (EA), 2003, superceded the ERC Act. It was the first legal document
to recognise the potential of renewables to provide grid electricity.
It provides for policy formulation by the Government of India and
mandates state electricity regulatory commissions (SERCs) to take
steps to promote renewable and non-conventional sources of energy
within their jurisdiction.
Enactments prior to EA, 2003, had no specific provision for promoting
renewable or non-conventional sources of energy. Due to this lacuna,
policies related to renewable sources of energy were left to state
governments and electricity boards. Although the Ministry of New
and Renewable Energy (MNRE, then MNES) attempted to give impetus
to the sector by way of policy guidelines in 1994–95, the efforts
led to mixed results. However, EA, 2003, changed the legal and regulatory
framework for the renewable electricity sector. While Sections 3,
61, and 86 in the Act contain the main provisions for accelerating
renewable-based electricity generation, Section 3 specifically mandates
formulation of the National Electricity Policy and National Tariff
Policy for development of power systems based on optimal utilisation
of all resources including renewable sources of energy.
Thus, EA, 2003, proved to be an enabling tool for the Indian electricity
regulators, who played a crucial role in bringing about a paradigm
shift in the electricity sector through proactive actions to promote
renewables. It is time now to take an independent, knowledge-based
review of their achievements, and analyse shortcomings and barriers,
so as to chart a future course of action for R.E. regulation in
India. With this objective in mind, the World Institute of Sustainable
Energy (WISE) is organising 'R.E. Regulation India 2010'—the first
such comprehensive conference to be held in India that aims to facilitate
multi-stakeholder deliberations on the past experiences of R.E.
Regulation and chart the way forward towards an 'electricity secure'
future.
